Property & Evidence

The Property and Evidence Section is responsible for maintaining all property collected by officers and subsequently submitted as evidence. The Property and Evidence Section tracks, stores, and maintains the property for criminal justice purposes and subsequently disposes of items as quickly as legally possible. Evidence being retained as part of an active criminal investigation or held pending a criminal trial will not be released without approval from the Black Hawk City Prosecutor or the 1st Judicial District Attorney's Office. Once an investigation or criminal case has been closed, the evidence may be returned to the appropriate owner, depending on the circumstances. All property held as evidence must be claimed within 30 days of a court disposition. Found property held by the Property and Evidence Section will be safeguarded until such a time it can be returned to its rightful owner, disposed of, or destroyed. Generally, the unclaimed property will be destroyed after 20 days unless held as evidence.

Property is released by appointment only. Contact the Property and Evidence Section during business hours to schedule a release appointment.

The Property and Evidence Section is located at the Black Hawk Police Department, 221 Church Street, P.O. Box 68, Black Hawk, CO 80422 and open from 8:00 a.m. to 4:00 p.m. Tuesday through Friday, excluding Holidays.

Property may only be released to individuals with government-issued identification. Some cases may require written approval from the District Attorney, Municipal Court Prosecutor, or Court of Record authorizing property release. Proof of ownership may be required for certain items.
